Amgen Temporarily Prevails in Legal Battle with Roche

February 28, 2008--Amgen won a preliminary injunction that temporarily prevents Roche from launching its anemia drug Mircera (methoxy polyethylene glycol-epoetin beta) in the United States. US District Court Judge William Young said he would consider allowing Roche to launch Mircera in the US if Roche agreed to pay Amgen a slightly higher royalty than it had initially proposed, and ensure that it wouldn’t charge prices above those for existing anemia drugs. In October, a jury said that Mircera infringes 11 Amgen patent claims; Roche hasn’t brought Mircera to market in the US pending a ruling on the injunction. CNNMoney.com
