Are Drugmakers Becoming More Vulnerable to Losing Patents?

March 11, 2008--The Financial Times notes that US courts have become more skeptical of existing patents, making it harder to stop generic manufacturers from launching competing drugs. Last year, an important appeals court made it easier to challenge drug patents on the grounds that their chemical formulas are obvious. Case in point: A US court recently invalidated Bayer’s patent for its Yasmin (drospirenone and ethinyl estradiol) oral contraceptive on grounds of obviousness. Financial Times
